Terms & Conditions of Use

These Terms govern use of our website and the privately managed Sparks Lake Activity Center property, including event requests, visitor guidelines, and safety expectations.

Agreement

Welcome to Sparks Lake Activity Center (“Activity Center,” “SLAC,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website, event request forms, property, programs, activities, tours, visits, and related services.

By accessing the website, submitting an event request, visiting the property, attending an event, or participating in an activity, you agree to be bound by these Terms. If you do not agree, do not use the website or enter the property.

Private Property Notice

Sparks Lake Activity Center is a privately owned and operated business venture. It is not a city, county, state, school district, government agency, public park, or public venue.

Sparks Lake Activity Center operates as part of a connected Sparks network that may include Sparks Lake Resort, Sparks Trucking, and Sparks Lake Network. While each operates independently, certain systems, data processing, and operational tools may be shared across affiliated services.
Separate Property Access

Access to Sparks Lake Activity Center does not include access to Sparks Lake Resort, resort cabins, lake property, docks, boats, resort amenities, trucking facilities, or any other private property unless expressly authorized in writing.

They do not guarantee specific features, timelines, availability, placement, naming rights, construction completion, or final outcomes.

Eligibility & Responsibilities
  • You are at least 18 years of age, or you are using the website with parent, guardian, or authorized adult involvement.
  • You have authority to submit requests or enter into agreements for yourself, your family, your group, or your organization.
  • All information you provide is accurate, current, and complete.
  • You will comply with these Terms, posted rules, safety instructions, and staff directions.
  • You are responsible for guests, vendors, attendees, minors, and participants connected to your event or visit.

We reserve the right to deny access, cancel or decline requests, modify requirements, or require additional conditions when necessary to protect the property, neighborhood, visitors, staff, and operations.

Event Requests, Scheduling & Approval

Event requests are reviewed case-by-case. Submitting a request does not guarantee availability, approval, pricing, date holds, or facility access.

We may request additional details before approval, including layout, attendance, parking plan, security plan, vendors, insurance, supervision plan, setup needs, cleanup plan, and event purpose.

Approved events may require a separate written agreement, deposit, payment terms, setup and cleanup windows, insurance documentation, signed waivers, and compliance with safety, noise, traffic, parking, and neighborhood limitations.

Security & Safety Requirements

We may maintain security features appropriate to the site, including fencing, cameras, lighting, access controls, and staff oversight. These measures do not guarantee safety or prevent all incidents.

For larger events, customer-provided security may be recommended or required. Requirements may include security staffing, traffic control, parking attendants, crowd management, emergency access planning, and other measures based on event size, activity type, timing, and location.

Parking, Neighborhood Respect & Towing

The Activity Center is located in a community neighborhood. Event organizers and visitors must respect surrounding homes, businesses, roads, and private property.

No street parking is allowed for Activity Center events unless specifically authorized. Vehicles parked improperly, blocking access, or violating posted rules may be towed at the owner’s expense.

Event organizers are responsible for communicating parking instructions and ensuring attendees, vendors, and participants follow all parking and traffic rules.

Assumption of Risk

By entering or using the property, including for events, activities, tours, recreation, setup, cleanup, or vendor work, you acknowledge that all activities involve inherent risks. These risks may include slips, trips, falls, weather, uneven surfaces, equipment, recreational activity, crowd activity, construction or restoration areas, and actions of other guests or participants.

You are responsible for your own safety and the safety of your party, including minors. You agree to follow posted rules, avoid restricted areas, supervise children appropriately, and act responsibly. Unsafe behavior may result in removal from the property.

Children, Families & Supervision

Sparks Lake Activity Center may host family-friendly events, youth activities, recreation, educational programs, and community gatherings. Minors must be supervised by a parent, guardian, school representative, coach, event organizer, or authorized adult at all times.

Event organizers are responsible for providing adequate adult supervision, emergency contact procedures, and age-appropriate safety controls for minors participating in or attending an event.

Prohibited Activities
  • Unlawful activity, trespassing, or entering restricted areas
  • Interference with cameras, fencing, locks, signage, security, or safety systems
  • Damage, alteration, removal, or misuse of property, equipment, signage, or facilities
  • Disruptive, unsafe, threatening, harassing, or abusive behavior
  • Unauthorized commercial activity, solicitation, vending, or promotion
  • Unauthorized filming, photography, or recording where restricted
  • Attempting unauthorized access to website systems, forms, dashboards, data, or infrastructure
  • Blocking roads, driveways, emergency access, parking areas, or neighboring property

Violations may result in denial of access, removal from the property, cancellation of events, loss of deposits or fees where permitted, and/or referral to appropriate authorities.

Donations, Sponsorships & Recognition

Donations, sponsorships, recognition opportunities, naming concepts, donor walls, brick programs, promotional references, and related materials may be subject to separate terms, availability, approval, and final design decisions.

Sponsorship or donor recognition does not guarantee permanent placement, specific wording, design control, exclusivity, naming rights, tax treatment, or continued display unless stated in a separate written agreement.

Data Systems & Operational Technology

The Activity Center may utilize internal systems, cloud-based platforms, form tools, automation tools, Google-based storage, Apps Script-style workflows, and dashboards to manage event requests, donations, sponsorships, scheduling, communications, and operations.

By submitting information or interacting with the website, you acknowledge that your information may be processed within these systems for operational purposes.

Operational & Public Displays

Certain non-sensitive information such as event names, sponsor recognition, donor acknowledgments, activity summaries, or general request status may be displayed on internal dashboards, office boards, live boards, public-facing displays, printed materials, or promotional materials.

Sensitive personal, financial, or private contact information will not be intentionally displayed publicly.

Network Integration

Sparks Lake Activity Center operates within a broader network of affiliated Sparks services. Requests submitted through this site may be routed internally or shared across systems when necessary to coordinate operations, respond to inquiries, manage services, or support related Sparks projects.

Website Use

You agree not to misuse the website, forms, or systems. Prohibited website activity includes spam submissions, false information, malicious code, automated abuse, scraping, attempts to bypass security, or attempts to access private systems or dashboards.

Intellectual Property

All website content, including text, images, logos, designs, maps, renderings, graphics, branding, and layouts, is owned by or licensed to the Activity Center or affiliated Sparks services and may not be copied, reproduced, modified, distributed, or used without written permission.

No Guarantee of Availability

Facility access, programs, events, features, construction timelines, amenities, sponsorship opportunities, and services are subject to change. We may modify, postpone, cancel, restrict, or discontinue any feature, program, event, or service at any time when necessary.

Limitation of Liability

To the fullest extent permitted by law, Sparks Lake Activity Center, its owners, employees, representatives, volunteers, contractors, affiliates, and related services shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from use of the website, submission of requests, attendance at events, participation in activities, or use of the property.

Our total liability, if any, shall not exceed the greater of fees paid directly to the Activity Center for a confirmed event or one hundred dollars ($100).

This section does not limit liability where prohibited by applicable law.
Indemnification

You agree to indemnify, defend, and hold harmless Sparks Lake Activity Center, its owners, employees, representatives, volunteers, contractors, affiliates, and related services from claims, damages, losses, liabilities, costs, and expenses arising from your breach of these Terms, violation of law, misuse of the website, use of the property, event activities, or actions of your attendees, guests, vendors, contractors, employees, participants, or minors under your care.

Dispute Resolution & Arbitration

We are committed to resolving concerns informally whenever possible. If you have a dispute related to the website, an event request, attendance at an event, or use of the property, please contact us first so we may attempt to resolve the matter.

If a dispute cannot be resolved informally, any claim, controversy, or dispute arising out of or relating to these Terms, use of the website, submission of an event request, attendance at an event, or use of the property shall be resolved by binding arbitration, except where small claims court is permitted by law.

Arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules then in effect. Arbitration shall be conducted on an individual basis only; class actions, collective actions, and representative actions are not permitted.

The Federal Arbitration Act governs this arbitration agreement. The arbitrator shall have authority to resolve disputes relating to interpretation, applicability, enforceability, or formation of this arbitration provision.

Nothing in this section prevents either party from seeking relief in small claims court for disputes within that court’s jurisdiction or temporary injunctive relief where permitted by law.
Governing Law & Venue

These Terms and any dispute arising out of or relating to the website, event requests, events, activities, or use of the Sparks Lake Activity Center property shall be governed by the laws of the State of Texas, without regard to conflict-of-law principles.

To the extent a dispute is permitted to be heard in court, including small claims court, venue shall lie exclusively in a court of competent jurisdiction located in Nacogdoches County, Texas.

Waiver of Jury Trial

To the fullest extent permitted by law, you knowingly and voluntarily waive any right to a trial by jury in any action or proceeding arising out of or relating to these Terms, the website, an event request, attendance at an event, participation in an activity, or use of the Sparks Lake Activity Center property.

Force Majeure

Sparks Lake Activity Center shall not be liable for delay, cancellation, interruption, modification, or failure to perform resulting from events beyond our reasonable control, including weather, natural disasters, construction delays, restoration-related issues, utility outages, governmental actions, emergencies, labor disputes, pandemics, public safety concerns, or other circumstances beyond our control.

In such cases, event approvals, access, programs, or services may be delayed, modified, rescheduled, restricted, or canceled as necessary to protect safety, property, and the community.

Additional Waivers & Agreements

Certain events, programs, activities, tours, or uses of the property may require additional written agreements, waivers, releases, insurance, deposits, rules, or acknowledgments of risk by event organizers, participants, attendees, or guardians of minors.

Failure to complete required documents or comply with safety conditions may result in denial of entry, denial of participation, cancellation, or removal from the property.

Privacy Policy

Your use of this website is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Changes to These Terms

We may update these Terms from time to time. Any updates will be posted on this page with a revised effective date. Continued use of the website, property, or services after updates means you accept the revised Terms.
